Existing Relationship-Service Improvement Plan Negotiation
What we deliver
-
A plan that is assured to be safely delivered. Service improvement plan facilitation and negotiation support that covers a combination of detailed technical knowledge, deep contractual expertise and strong relationship management skills.
How you will benefit
-
Collaborative outcome. This structured approach to agreeing on the service improvement plan is ‘interest based’. In this way, you work together to agree the plan, and in turn, the supplier remains contractually accountable to provide the agreed fit for purpose service and/or solution.
-
The supplier’s advice is contracted for, separately. This process ensures the supplier remains contractually accountable for its advice, in view of the complexity of the service/solution procured.
Key contents of the Service Improvement Plan Negotiation
Understanding of outcomes to be achieved
BPG facilitating discussions so the supplier and the client are clear about outcomes to be achieved, taking a ‘fix first’, ‘responsibility later’ approach.
Genuine collaborative working
We help to support on-going collaborative workshops across both your own and the supplier teams to assure the service improvement plan is fit for purpose.
Collaboration aligned to contract terms
We will assure that the collaborative working during the ‘fix’ period, does not undermine any of the contractual protections or business outcomes contractually agreed.
Constructive negotiation
Where appropriate, we’ll involve the respective supplier and client legal teams early in the process. This is to prevent later objections in signing off the service improvement plan.
Roles and responsibilities
The supplier’s ‘Expert Responsibilities’ need to remain intact, whilst client teams support the supplier’s remediation efforts. This supports the ‘fix first’ approach.
Plan ‘B’ (fall-back planning)
Our experience of over 500 complex relationships, means that we know there are times when suppliers can’t (or won’t) deliver what has been agreed. Contingency plans are put in place.
Performance management governance
The performance governance regime is critical to assure that (a) the project achieves its agreed outcomes and (b) does not undermine the contractual protections agreed.
Remediation Project Planning
Clarity from both supplier and client in remediation is critical. Our ‘Optimise’ planning process assures the project starts with the ‘end in mind’, retaining contractual protections.
